Terms & Conditions
This details White International’s Pty Ltd ABN 48 000 119 380 Agreement of use of this service including the website and email marketing tool, in this section “we”, “us” and “our” refers to White International & brands/promotion we represent. The “service” refers to providing selected resellers access to our email marketing tool (including our website) to enable you to send online bulk email campaigns to your customer.
We will assist you to distribute our promotional flyers via email, using our email marketing software and listing your business as a reseller of the promotion you have opted into. This is a bonus tool we provide to selected customers. We reserve the right to end this agreement at any time.
Eligibility – Customers eligible to use this service must be taking part in the current promotion we are running. Your business must be a physical shop and must be willing to list your stores address on our website. Although the prices listed in the flyers are recommended only and there is no obligation to comply, by you sending the flyer to your customer you agree to honour those prices as you advertised.
Subscriber Emails – We are providing you with the tools to send bulk emails to your customers, therefore you must provide the subscriber list and ensure you have followed relevant spam legislation such as the spam act 2003.
To send an email via our service you must have clearly obtained their permission. This could be done through:
- If the customer has purchased from you within the last 2 years.
- If you were given their business card and you had asked them permission to add them to your email marketing list. (If you placed a bowl on your counter for customer to drop their card in, there must of been a sign saying you would email them)
- An email subscribe form on your website
- An opt-in checkbox on a form. This checkbox must not be check by default, the person completing the form must willingly select the checkbox to indicate they are happy to receive emails from you
- If you run a survey or promotion that required then to complete a form, where you clearly explained you will email them if they tick a box
Depending on the size of your subscriber list, we may require details on how you obtained permission to email your subscribers.
You agree that any email sent by you or on behalf of you through your email account we create, you are fully responsible for emails sent to your subscribers. White International will not be held liable for any breaches of the spam act, or other issues that could arise from your actions.
Adding Subscribers from your website – to assist in building your email subscriber list, we can provide you with appropriate software code to insert on your company website, linked to your online subscriber list. Please contact us to discuss these options.
Sending Email – email campaigns sent from our email sending tool must only be on the approved template provided by us. We have allowed the ability to edit the content on each email to contain your local stores contact detail, address, logo, and special messages to your customers. You must not use this service to distribute illegal content, chain letters, pornography or gambling content.
You will need to provide a “From Email Address”, “Subject” of your email, and “name of sender” on each campaign.
Strict rules for sending emails – All White International customers must follow the Anti-Spam policy when sending email through the service. We require the following of all email messages sent:
- All emails must contain an “unbusbcribe” link that allows subscribers to remove themselves from your mailing list.
- All emails must contain non-internet contact information of the sender, such as your address and phone number
- All emails must state the reason the subscriber is receiving the message. For example “You are receiving this email because you signed up to our subscriber list when visiting our store”.
The unsubscribe feature will be set on each email template. Points 2 & 3 you are responsible for adding your details/content to each email campaign you send.
Validating Email Domains – you can send your bulk emails from your stores normal email address, however some spam filters may filter out your emails without it being validated. We can validate the “sending from” email addresses; by giving you a code to add to your domain DNS settings or we will allow emails to be sent from our domain “storename@tooltalk.com.au”. This should only be used if you find previous campaigns are being stopped by spam filters when using yours stores own email address. If you select this domain, your email address should represent your store name. Please speak with us first before trying this option.
Business listings – Each reseller listing is decided by us and no guarantee for your business to display on our website. Listing will be display by geographic location based on closest distance to searched suburb or area. You are responsible for ensuring your details are correct, this includes contact details, map location etc. We reserve the rights to remove any listing at our discretion; this may be due to mis-representing our brand, or not supporting the promotion, etc.
Cost / pricing – We reserve the right to change our pricing structure for this tool at any time. You will be notified by email of any changes to our pricing for this tool.
Support – We endeavor to assist you in setting up your email service, personalise the HTML email communication and use our email marketing software. Training will be provided in a format at our discursion, this may include tutorial videos, in-store demonstration, or over the phone. We will not however send all emails on your behalf.
Tracking Data – Each email campaign you send will provide a detailed report and analyst based on open rates, what links are clicked etc. This information can only be used for the purpose of improving email communication; we reserve the rights to remove access to reports at any time.
Limitation of liability – under no circumstances shall White international or any service provider, employee be liable to you or any other person for any loss of damages. This includes but not limited to any loss of profits, revenue, data, etc.
White International reserves the right to review sent campaigns to ensure they follow our guidelines. We may also review campaign performance in order to improve design and layouts for more successful campaigns.
